My husband died recently, the mortgage for our house was under his name. my name is in the deed, Since he was the breadwinner I can’t pay the mortgage. my question is am I responsible for the mortgage?(since the loan was under my husbands’ - even if I pay the mortgage now since I didn’t establish credit history it would be hard to transfer the mortgage to my name) and if yes what do you think of short sale or if you have any advise I would really appreciate it. I have a condo that will eventually be foreclosed on, I have been trying to short sale it with no success. I have not been paying the mortgage for over 6 months. I went to a bankrucpty lawyer today to discuss filing bankrupty because I won’t be able to pay the tax liability if I get a 1099 or the deficiency judgement, if I get one. he said I should file before I get a possible deficiency judgement and that would cover a potential 1099 situation, and if I end up with a deficieny judgement, I just reopen the bankruptcy filing to cover that judgement. This does not sound right to me, don’t you want to file after the 1099 or judgement, after they say you have to pay the debt? If I file now, before it is even a debt (not even foreclosed on yet), how can that be included in a bankruptcy filing?
I’ve had this happen twice in the last month and was wondering if it was just particular to my area or a nation wide phenomenon.
Have you noticed banks driving up bids on short sales with blind submissions, countering back at a price higher than list and then foreclosing on the home only to put it back up for sale at a substantially higher price . . .
Just curious if this was widespread practice or if it was just a case of lightening striking twice. Any thoughts?

how long after you sign an arms length affidavit for a short sale does it take on average to hear if you have gotten approved from then bank…?
Apparently the bank did not release them from the deficient money leftover from the sale, therefore they can get out of the sale. The backup offer was $30k more and now they want that from me.
I am the buyer who agreed to one contract to the bank at a time and there was a backup(who by the way found another house already)
My home is currently on the Arizona MLS and last night I was contacted by “fast home offer.com” or fasthomeoffer.com
The gentleman stated that he wants to make an offer on our home and asked me questions like what is it listed for, do we have tenants currently in there, do the tenants pay their rent on time, is the home in good condition, who our mortgage loans are with (1st and 2nd) and our Realtor’s contact information. He said he was going to call our Realtor and make an offer. I don’t want to get my hopes up and I am wondering if this company is legit? Has anyone experienced this company making an offer on a home for a short sale and if so was their offer decent enough that the banks will accept it? Our FMV of our home is $100,000 right now and it’s been on the market for 70 days.
